    Pessimistic I know...Have to ask

    I found a few weeks ago that we had several accounts that were not listed on our BK and I asked my attorney what we would need to do to add these in to ensure that they are discharged. We are currently discharged but were changed to an assest case becaues of our 2008 tax return..here is his response. I find this hard to beleive and I would hate to have done all this to still yet owe money and have people hounding me? This was the response of my attorney.....This just seems too good to be true...and Not likley?? I don't know I haven't been the happiest with this guy so I'm untrusting.

    You have to pay $260 to reopen and then $26 to add creditors. Hardly
    seems practical given that all your debts are old and remote. There is
    also legal support under 11 U.S.C. 526 for the theory that debts not
    listed in a non-asset case like yours are discharged anyway. Frankly, I
    wouldn't do it. YOur credit report will show a discharge effective the
    date you received it. Creditors not likely to pursue you if the debt
    incurred prior to that date. Shouldn't be on your credit report after
    discharge date either.

    In many districts, a creditor omited in a no asset Chapter 7 is deemed discharged since, they'd have received nothing even if they had been informed.
