    Questions from US Trustee??

    Did anyone get questions from the US Trustee in their case? If so, how did it go? I got a message from my lawyer about questions from the US Trustee (she didn't say the local trustee, or use my local trustees name). Too bad I didn't get the message yesterday. Now I have to wait to Monday.

    What did the US Trustee want to know?

    How did things turn out?

    The US Trustee appeared by telephone in my case.

    The US Trustee participated in my 341 hearing and then the hearing was continued and finished by the panel trustee.

    I was warned right from the beginning by my attorney that the US Trustee would be interested in my case (probably because I was over median income substantially). My attorney was right. In my case the US Trustee 'appeared' by telephone and the panel Trustee directed all the questions (about 30 min) with the US Trustee jumping in at the end to ask just a few questions. The questions were primarily transaction based - like where did you get down payment the funds to puchase your home? Your rental property? Who is _______? (here they were naming indviduals I had named in my petition) and what is the relationship (they were my brother and sister). So they were interested in any repayments I had made. The Trustee was interested in the expenses in my Schedule - how did I come up with certain figures etc.

    I had provided lots of documentation going back years per my attorney's instructions, so at the end of the 341 they did continue it so they could review the rest of the documentation. The continued hearing was very short, a couple of questions to clarify the expenses and that was it. I was declared a no asset Ch 7 -

      Thanks so much for the quick reply and thorough answer!! I am over the median income by about $5K after not working for the past 3 months (on leave without pay b/c I had a baby). I am so happy that things went well for you. I guess I can expect the US Trustee to be monitiring things.

      One more quick question - Did you get any questions from the US Trustee before your 341 hearing?

        It was more like the local Trustee had a list of questions and the US Trustee listened and just added questions for clarification toward the end. I am sure that they spoke about which questions to ask long before the meeting so that everything was covered.

        The questions were detailed. My petition was also detailed. I am a detail person so it did not really shake me up at all. But I kept all answers short and sweet (contrary to my postings on this forum!)

          Yes, well I will have to be very prepared and detailed as well. I have a good lawyer, so I guess until I speak next with him, there is nothing I can do.

          Thanks so much for your help!! This is the most daunting thing I have ever done, so I want to make sure everything goes well.
