Should be filed for Ch.7 by Friday!

I know the next step is the 341 meeting. How long does it take from the date of filing till the meeting? I'll be getting a couple of appraisals for my 2000 4Runner before the meeting since that's my only asset. Will my case by looked at as an asset case? I'm hoping the value comes in low on the car. If they decide to take it, when would it be seized? Maybe they can drop me off to the funny farm on the way?

I can only answer part of your question. The 341 should be 30 days after you file, but some courts are getting backed up. (Mine is exactly 30 days, but I recall that someone posted about filing the same week I did who has a 341 set for November.)
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

I believe the 341 meeting can be up to 60 days from your day of filing... but most are within 6 weeks.

I filed at the end of June and 341 was at end of August. Mine was almost 60 days from day of filing.

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

          Hi Amislander,

Have you looked at www.kbb.com (Kelly Bluebook for Used Autos - Online). I'm not an attorney, and am certainly not giving legal advice here, but the 2005 version of Nolo's book, "File your Own Chapter 7" suggests using the KBB "Trade-In-Value" as an estimate of your cars worth, then also deducting the amount for any repairs it may need.

          Just a thought...

          All the best,
          Ronnie
