I picked up citibank summons...as directed by attorney and took it to his office..the summons was from another company or attorney that had bought my debt... is this legal to do and not even notify or send a bill out?

Happened to us while when we started in the debt consolidation program. We had made like 2 or 3 payments and we got the summons. Called the debt consolidation program and they told us, oh yeah, they didn't return our calls, we were too far past due and that they had not heard from us. DUHHUH, that was their job, especially when part of the agreement was that we were to have no contact with our creditors. Basically, after contacting the debt consolidation company, and the creditors attorney, we were sol. that should have been our first clue with the debt consolidation company.
If you are in the process of bankruptcy, what is the problem? Aren't they listed in your debts? IF the account is joint (not meaning only one is an authorized user) and only one of you is filing the other party is responsible for the debt. Good luck keep us posted.

You have nothing to fear.
As long as your BK was filed before the Citibank court date, you will be okay. BUT, let me say this. Unless your attorney is 100% sure Citibank's attorneys will receive a suggestion of bankruptcy before the court date, you need to appear in court. You need to go and tell the judge, or mediator, that you have filed for BK. This is why....if they don't receive the suggestion of bankruptcy in time, and if you are not in court to explain your situation, they will win a default judgment. They won't be able to collect if they are on your BK petiton, but the judgment will still end up on your credit report. This happened to me after I was assured things would be fine. This is why I am able to tell you this with all certainty. Even if your attorney tells you things will be fine and that he will take care of it, your best bet is to appear in court and tell the judge you filed for BK. Yes, you paid your attorney to deal with this, but it's always best to cover your own butt.

Are the spouses ever anwhere to be found, now that is the question???? Floridagirl is right, you have been served (notified) or a court proceedings, do not, do not, assume that it will go away. You should be there with the name of your attorney, the date you filed bankruptcy, the date of the 341 meeting, and most importantly the case number. Because rules of proceedure vary from location to location see if you can get something in writing as to the outcome of the summons. THe clerk there maybe not the day of, but can usually give you something in writing to have. You will want to pay attention to this account on your credit report, when you check it after discharge.
