    It is my understanding that it is usually figured in over the course of the year as income. You should be alright. We received more than that and did the same thing- played cath up with fuel bills, insurance, property taxes etc. I could account for the bulk of it off the top of my head. He didn't take ours
    Just to let you know, we did get asked about it so you can be prepared to respond.
    Not to cause you added stress - In the scheme of things, for us at least even if they had taken it, (glad he didn't) it would have been a drop in the bucket for us against what we owed. Please keep us poseted and good luck.

      had my meeting last week and i am in Illinois..he only asked about if i had received one for 2004 and that was it.

        The trustee can only claim a % for the year up until the date you filed. So, if you filed on Aug. 31, he could claim 2/3 of your refund (less any EIC apparently) as you would have filed 2/3 thru the year.

        Does your state have any wild card exemptions? Perhaps you could list the refund as an asset & exempt it.
        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

          I actually included mine into our income on the petition- was that right or wrong? My husband being commission only, we do rely on that and do budget it in.

            Our trustee asked if we received a tax refund in 2004 and for how much. She asked what we did with that money and then asked if we expect a similar tax refund this upcoming year. Some people she told them she wanted their tax check and NOT to cash it or spend it or else the discharge would be revoked. She did not say that to me and I usually get between 3500-4000 back. Good luck.

              I guess I'm safe from that question then...

              Having a huge back tax bill... I can honestly tell the trustee that I don't anticipate a refund for the next 5-6 years.
