I am trying to qualify for chapter 7 in the state of ohio. I was wondering if my wife is on short term disability for a short time before i go bankrupt does that help my gross wages for the past 6 months or does that not count and they just look at it like she will eventualy go back to work and be making the same money again? Thanks for everybodys help

Whatever short term disability income and regular income your wife received during the six full calendar months before you two file will count into your combined gross income when the Ch 7 filing forms are filled out. The courts don't care that the short term disability money is not reflective of her actual normal income - the bk law mandates the six-month lookback be totalled from ALL sources.Originally posted by kevinB003 View PostI was wondering if my wife is on short term disability for a short time before i go bankrupt does that help my gross wages for the past 6 months or does that not count and they just look at it like she will eventualy go back to work and be making the same money again?I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
