    "Where the metal meets the meat"file now or later

    Filing BK is a very personal decision, that goes without saying.
    Big brother's hammer is going to fall hard on Oct 17th. And it will not be
    a pretty sight in the coming months & beyond. The moral here is:

    1. Do I file now with or without an attorney? (chp.7) I am referencing
    2. Or do I wait an think things will be favorable on the 17th an after?
    3. We all know that atty. fee's will most likely double..
    4. And we all know that your creditor's want you in Chp.13 instead of 7.
    5. We all know that your congressman or congresswoman are in bed
    with the creditors...Not all, but 80% are.

    Today was a day of 1st's for me & my wife. We filed chp.7 pro se (without
    atty). I have never missed a house or creditors payment , never late!!!
    30 years of great credit history.... So friends make no mistake I am not going to slam the legal system, please remember when the 17th arrives, it will never be the same again... In this regard, I wish you all the best.

    Where did you get the information in your post about the bankruptcy law changes?

    If you can't reference an article or news story or anything, you only fuel the fear and cause people to panic unnecessarily.

    Attorney's fees will double? Says who? How many bankruptcy lawyers do you have lunch with?

    Creditors want you to file a Chapter 13? That's a no-brainier. Obviously they want their money. They want it now, and they'll want it under the new law. You borrowed it. They want it back with the fees and interest added that you agreed to.

    80% of congress is in bed with creditors? That's a good one. Where did you come up with that? Did you request campaign contribution statements from every member of congress? How many letters did you write to your representatives about the bankruptcy reform? What rallies did you attend or host in protest? Obviously you at least voted for all the opponents of the people in office.

    Don't make stuff up because you're mad.

      Lightning, the atty's fees will DOUBLE! A blind man can see this one. Lawyers will have to certify their clients and will have to pay if the client isn't up front about everything. Atty's mal practice insurance will go up and they will pass these costs over to clients. There will also be more prep work which will use more time which equals more $$$.

      Most people are cynical about their elected officials. Whether they are bed partners or not why should we believe these people with their reputations being what they are on BOTH sides of the isle?

      Reform is needed as is personal responsability, but the same people that re-wrote the laws are putting us and our unborn children and grandchildren in debt with their spending. Now that they are forcing us to seek counseling they should take some of their own medicine.

          Then how do you know the fees won't TRIPLE? Either you're pulling numbers out of the air or you've talked to lawyers or read/heard some news articles on the subject. Which is it?

          The country is in debt. Whether or not your unborn children or unborn grandchildren end up with personal debt is up to them and the education you as a father and grandfather provide to them.

            I would definitely file before the 17th. I was discharged almost two months ago and am glad I made it under the wire.

              I'm not talking about personal debt. I'm talking about politicians writing tough laws on how we should be responsable with money & debt while these IDIOTS tax, borrow & spend other people's money. We can educate all we want, but nothing will change with that.
              Lightning, I try to have respect for the few common sense things you say, but you are just too one sided and that's why the few times you are correct you just don't inspire anyone here and it shows by everyone's replies to you.

              This is the last I write on this thread to avoid more clutter.

                whether it be double or triple will depend on the lawyer, but the op is correct it will go up, who cares by how much, am I correct, no need to berate the op for that. Also he is correct that many politicians are in bed (so they say) with creditors. A politician caters (no matter what they tell you) to the people who have and give them political contributions. Credit Card companies have huge lobbying groups that work for them in rallying politicians to vote specific ways in regards to credit related bills, and especially in regards to bankruptcy laws. If you don't believe that, check out the federal contributions to campaign funds which is public record. You will find that some of the largest contributors to political campaigns are companies like Citigroup.

                  I spoke with my attorney and his rates are $850.00 + filling fees $209.00, for chapter 7 under the old law. His new rates, after the new law, will be $2,500.00 + filling fees $309.00 (appox. on filing fees, he actually said about $100.00 more then old law for filing fees).

                  And I didn't even have to have lunch with him to find this information out
