Where to list wife's 401k loan? Help, please?

    Hello-

My wife took out a loan against her 401k plan last year and is paying it back through payroll deduction. I have the amount being payed from her check listed properly, but not sure which schedule to list the outstanding amount of the debt still owed, or the original amount of the loan.

Any help would be greatly appreciated.

    All the best,
    Ronnie

I'm not sure about this one... I understand that 401k loans are not allowed as an expense, as it would be considered a preferential payment. (She is paying herself.)
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

        Thanks StaciMM,

I just listed it under Scedule E, Priority Claims. I know it survives the B/K anyway.. just wanted to be sure the Trustee Knows about it.

        Much appeciation!!!
