    $600 within 90 days of filing

    First, we filed Sept. 14

    I was going over my checkbook looking for something when I noticed I had paid a creditor (Chase) an amount of $701.00. I remembered then, that it was a double payment back on June 22. I had missed the May payment and was playing catch up. I had no intention, at the time, of filing for bankruptcy, so I was just trying to pay my bills. I owed that card something like $17,000, so the monthly payment was 350 per month. Thus, the $701.00 on June 22.

    Anyone see this as a problem? I haven't contacted my lawyer. I keep calling him with dumb questions and am beginning to feel a little stupid.

    I don't see why it would be a problem. If nothing else it shows that you were doing your best to pay your creditors, but it just got to be too hard. As long as you can show that the money went where you said it did, there is nothing to worry about. I doubt there would be anything to worry about anyway seeing as how this was 90 days ago.

      That shouldn't be a problem, but it's pretty much posted all over this forum that this really isn't an issue for debtors, unless it was paid to an friend or family member or a doctor, dentist who is friends of the family in which you will have a new enemy. The trustee will just go after Chase if it's worth their while and get the money back.

        Its not a 'problem' for you, but something that should be documented in your petition. Did you make any other payments to them, like in July or August? They should be listed, and the trustee will go to them to get the money back & spread it among creditors (and keep some for himself).
        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

          thanks, everyone. I'm so tired of looking at all of this, I'm basically just taking the "throw it all up in the air and seen where it lands" attitude. Staci, I didn't make any subsequent payments after that one because I then decided I would file bk.

          I think I just won't worry about it. 341 on Oct 25.

            Wow accentone - you just said what I have been feeling - throw it up in the air and see where it lands. It is getting so hard. The more I read, the worse I worry. Things are either going to work out or they won't.....right? Our 341 is November 10th. Until then....maybe we should stop worrying....yea right! The worse thing that can happen is that we are converted to a 13, right? Let us know how our 341 goes.
