I was discharged a little less than a month ago. I had a few hiccups along the way that got me paranoid and still does on occasion bring that out in me. Those were minor (trustee wanted to see more CC statements, questioned some transactions on my bank statements, etc.) compared to some here. In the end I was honest and I got my discharge in about 70 days after 341.
Now I want to move on and here are my questions. Forgive me if some are bonehead obvious. I just want to be sure I'm on a good path.
1. Reaffirmation of my house: I kept my home in this Chapter 7 and I wanted to sign a reaffirmation as a way to rebuild credit. I signed an "intent to reaffirm" and didn't realize until about 30 days after 341 that I needed the actual agreement. I contacted mortgage company and my lawyer several times. It just dragged on. Reaff came on day 60, I signed, lawyer sent back to mortgage company that same day. I was discharged 10 days later. Just found out the mortgage company did not file with the court. They dragged their heels.
My lawyer says the Judge here doesn't believe reaffirmations are in the best interest of the debtor and that I should not pursue even though case is not closed just yet. Lawyer says judge will not approve based on this philosophy. My home value is above what I owe by around $6000. My interest rate is good with a fairly low monthly payment that I can handle.
Q1: Should I pursue this matter with the court?
Q1a: I assume the mortgage company would want to hold me to this property debt. I never missed a payment and have paid off several loans in good standing with them since 1995. My rate is good, but todays rates are better. Is it possible to get a refinanced loan with them to get it reported?
Q1b: Any chance of an outside mortgage company giving me a refinance?
2. I want to sell personal property from within my home via eBay for some extra money. Am I free and clear now that discharge is over and said property is no longer in control of the trustee?
3. I applied for a state tax id for sales tax. I want to turn my hobby of photography into extra cash and I will be selling prints. I'm on a mission to maximize my meager income. Any pitfalls in doing this so early after discharge?
4. I have no debt now other than my home and utilities. I don't need a new vehicle. What is the best and quickest way to rebuild credit if this home reaffirmation does not happen?
In general I'm looking for any guidance as to what I can and cannot do now after discharge. I've been in limbo for many months and it feels weird trying to get reestablished. One part of me wants to roar out of the gate and the other is very cautious.
