    Can the bank come after me?

    I'm sorry if this has been addressed before. I've been looking around and still not sure what the answer to my question is.

    I'm currently filing Chapter 7 and including all debts except my living residence.

    My question is about a possible future scenario.

    If the bankruptcy becomes final, and I continue to make payments on my home, but then I lose my job and can no longer afford to make payments, can the bank come after me at that point and force repayment (garnish wages, etc.)?

    If, you reaffirm the mortgage you will be on the hook for any deficency balance in the event of a default.

      oneinchpunch, you must include all debt in your paperwork. I assume you have a lawyer, but if you reaffirm as stated above by "Keepmine" you will be on the hook. However, if you "pay through" (meaning just stay current at all costs, and not late) they are likely to enjoy taking the money rather than owning another house. After you are discharged, you are not discharged from this debt 'so-to-speak' as you are paying on a secured item. You can however, abandon it, let them repo it, and not suffer a law suit for the balance. It is better to 'pay through' than reaffirm as you give up bk rights with you reaffirm. 'Hub
