? RE: non-filing spouse and ? re checking accoutn

I am preparing to file chapter 7 here in california. I have a couple of questions.
CA is a community property state. I am fiiling by myself because all my debt is credit card, under my name only. I have no assets of any kind.

Can the creditors force my husband to pay my credit card debt? He has no assets except or 2001 Toyota which is under his name only. I have heard different answers about this, since CA is community property.

Also I read on some web page that it's a good idea to close your checking account before you file bankruptcy? I only have about $100 in it, so would it really make that much of a difference?

I believe that in a community property state what is yours is his and vice versa. They will come after your husband for the debts you discharge. There is no reason to "close" your account unless the bank you use is also involved in your BK, (credit card/unsecured loan etc) Hopefully, you have consulted with an attorney to be sure of your rights and his. If not, almost all offer free consultations. Good luck.
