Filed last July 2008, credit card debt and IRS debt.....in August my wife's father died and left her 40,000 via a trust and an IRA...we signed over the trust money to the trustee in the fall, we have been waiting ever since for the trustee's lawyer to find out if the IRA is exempt or not, it's going on 10 months now and we're still waiting, and accruing interest and penalties on the IRS debt. When we learned of the inheritance we offered to repay all that we owed using the IRA and trust but were told by our lawyer that the trustee wouldn't let us withdraw the bankruptcy because then he wouldn't get his money for the case. On March of this year I lost my job so now we are in severe financial straits..we have more than enough assets to pay off our creditors but can't do it and now cant we access any of the money to help or current position. I'm wondering if the trustee and his lawyer are in line for more money the longer this goes on and maybe that's why it's taken so long or/and have we got bad advice by our attorney?
