    please HELP?

    HI I HAVE A QUESTION I HAVE WATER FOUNTAIN ISSUE THAT MY HANDICAP SON SUPPOSE OF BROKE BUT THERE NO WITNESS JUST THAT THEY GOT IN IN THE OFFICE WITHOUT CALLING ME IN AND BE THERE WITH HIM, AND GOT HIM TO CONFESS. HE AS AUTISTIC CHILD AND BIOPLAR CHILD.THERE ARE AFTER 7,000 DOLLARS THEY WANT ME TOPAY AND I HAD LEGAL AI D BUT THEY SCWRED ME BIG TIME AND SAID WELL THEY SUGGESTED USING THERE INSURANCE TOPAY FOR IT AND NOW THE INSURANCE IS COMMING AFTER ME AND FAMILY AND SINCE LEGAL AID SAID HE WAS HANDICAP CHILD THEY THREW IT BACK AS THE PARENTS RESPONNILITY. SO KNOW I DROP THEM AND I CANT REALLY AFFORD ATTRONEY , SO ILET ME INSURANCE CO TRY TO FIGHT BUT THEY SAID IF HE WILFUL DID IT THEN THEY WONT APY. BUT AGAIN NO WITNESSES, OR EVEN A CAMERA. BUT WHAT I ASKING IS I DONT KNOW IF I SHOULD FILE FOR 7 OR SHOULD I TAKE MY CHANGES HOPE MY INSURANCE WINS( THEY ASKING FOR A TRIAL) SINCE THE JUDGE IS GOOD FREINDS WITH THE SCHOOL. AND IF I WAIT CAN I FILE BANKRUPTY IF I LOSE IN COURT? ALSO THE PRETRAIL WONT BE TILL JUNE OF 2005, AND I HAVE MY CREDIT CARDS AND A VEHCILE REPO SOON AND I DONT KNOW WHAT TO DO. CAN ANYONE GIVE ME ADVICE ON WHAT TO DOI AM AT A NERVOUS BREAK. PLEASE ANY ADVICE BUT I DONT WANT THE SCHOOL TO TAKE ME B/C HE DIDNT DO IT.i work for these people and they do this to me, so this tellyou how they feel about there co workers, but it ok for sportsplayer to tear stuff up but when it comes to a handicap child that suppose to have an a 1-1- aid and refuse it. oh well thanks for listening to me and my problems. angie

    there is help

    talk to your community center board for persons with developmental disabilities. let them know the issues. trust because they deal with people with disabilities daily they know what direction to lead you to.

      Angelina, I am not one of the 'legal minds' on here so all I can really offer is sound moral support but I sure feel like you need and deserve it, so I had to speak out here. I am APPALLED by this. Crap like this is one of the many reasons I home school my daughter. She has some special needs too (Juvenile Diabetes) and they weren't willing to accommodate her on that issue either. One thing that you may not be aware of- when a child in public school has special needs, that school gets extra money from the government for 'accommodating' that child, whether they do anything out of the ordinary for him/her or not. I'll bet your son's school gets extra money on the sly because of your son's dual diagnosis (Autism and Bipolar). But back on track here, it seems to me like many public schools are nothing but greedy, money-grubbing institutions and the people they want to bleed the money out of are honest, hard-working, but far-from-wealthy parents such as us. Now let me interject here- IF YOU ARE A TEACHER OR PRINCIPAL OR OTHER EMPLOYEE OF A PUBLIC SCHOOL AND I HAVE OFFENDED YOU, SO SORRY, BUT THAT'S JUST MY TAKE ON THINGS. IT ISN'T PERSONAL, OBVIOUSLY, SINCE I DON'T EVEN KNOW YOU. Personally I hope you tell that school to stick the water fountain somewhere the sun doesn't shine. This makes me really angry, the way they used your son as a scapegoat over a damaged water fountain. And since they have done this, it has created yet another financial disaster for your family because they fingered you and made the insurance company come after you. If you can't manage to get a legal aid lawyer or one in your price range, yes, it sounds like a Chapter 7 is the answer. I think (the legal know-hows can correct me if I'm wrong here) that even if you wait and let this issue go to court and plead innocent on the damaged fountain and they win a judgment against you anyway, you can still file Ch. 7 immediately afterward, in which this settlement should be discharged like any other debt. Like I said, if I'm wrong, someone please correct me there. Be sure if/when you file that you list both the school and their insurance company as defaulted creditors so that this debt will be included and discharged. You could actually tell the school's insurance company yourself that if they don't drop the suit, you're simply going to file Chapter 7 and they may decide it's in their best interest to drop it because, after all, it is costing them some money to sue you and if they think they won't get anything, they may cut their losses and move on. Best of luck to you Angelina. And you know what? If/when I filed for Chapter 7, I'd tell that school and/or department of education "Thanks to you singling out my son this way, you have pushed my family into bankruptcy with this $7,000 water fountain bill. I do hope you're proud of yourselves." What can they do- fire you? I should think not. You'd just be telling the truth. No harm in that. Take care Angelina.
