    Credit Card Charges


    Hello
    I have had excellent credit for over 6 years and I am filling Chapter 7. All of my debt is unsecured credit card debt. Does the trustee or the creditors ever review old credit card applications that were filled out 1 or 2 years ago to see if there are and discrepencies? Also do they ever review the charges? Balance Transfers? To what extent can they track and monitor all of this information? And will they ever try to use it against me the person who is filling chapter 7?

    Hi,

    Your past excellent credit history will not have any impact on you Chp 7 petition. Just let your debts default for a mininum of 6 months before filing your petition.

      Thanks for the answer but can you respond to all of the ?. Also is a Circuit City Visa Card Secured debt or not? :p

        Circuit City cards are secured credit cards. I have never heard of any cases where the creditor or trustee reviewed past credit card applications for diiscrepancies. Kim, it sounds to me as though you are experiencing anxieties of being audited for a Chp7.

        Unless you are trying to discharge debts in excess of $100,000 in unsecured debts, and have a lot of assets. Don't lose to much sleep over filing for a Chp7. If these is your case, then you're petition would be likely to get audited by the creditors/trustee to see if you're trying to commit fraud.

        Just let your debts default for 6 months to 1 year, prior to filing for Chp7. You will need to demonstrate an history of fiscal inability to repay your debts.

          Question to Todd,
          If there was a job loss but at filing I am still mostly current on my cc bills, will this be negative as far as filing a BK goes?
