What exactly are Means Tests and when did the use of such come into effect?
I filed Chapter 7 in 2005. In NO WAY did I qualify to file bankruptcy AT ALL. The attorney who had me file BK made no reference to Means Testing.
Long story short, I went to another BK attorney who looked over my petition that my original BK attorney drafted. He shook his head and said, "This is sloppy work. GAWD, what a mess." He then informed me that the only recourse I had at that point was to SUE my former attorney for malpractice.
I wanted to withdraw my BK because I later learned I did NOT qualify. (Early on, a different attorney told me that I could not withdraw.) And when I found the BK firm that pointed out the malpractice, they said that there was nothing they could do to save me at that point. Once a 7 is filed it's a downward spiral. They also told me that my attorney (and her partner) had reputations. Very BAD reputations. Her partner had had his license suspended on MANY, MANY occasions.
Yanno, I'd just been thinking about all this and feel that it is just NOT RIGHT that anything like this should've happened to ANYONE.
Is it too late for me to file a grievance with the AGC against my original attorney?
