    Redemption Objection Pt. II

    Hi there.

    I had an objection to the redemption for my vehicle because they thought the offer was way too low. Now I saw on Pacer that there is a hearing about that in a couple weeks. What should I expect? Why couldn't the attorney's can't just hash it out?

    thats how they 'hash it out'. everything is reviewed and overseen by the judge. whatever they do in the background gets reported to the court.

    start finding ads, prices, sales, docuentation lists autotrader, newpaper, etc that support your price for it. see if that helps the attorney.

      On the bright side-the hearing should be final. The trustee gets the final say. Its a bit like your attorney says $5000 and the lender says $7000 and if they can't work it out-the trustee settles the matter. His answer is final though...
      Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

        So I don't have to appear, it's just the lawyers? I'm not sure where the lawyer came up with their figure, but honestly, they are lower than what I've found on kelly blue book and searching for similar cars online and in the paper. Edmonds is within $500-600 of this, using trade-in value.

          the trustee decides? the trustee is not on the side of the debtor by any means. if thats the case then there is a method of taking it further so teh judge rules. ive sat in court where this was happening.

          back before i even filed. i was thinking, geeez if this goes on for every item i own its gonna be a mess of a bk lol

            If both parties (bk atty and trustee in this case) can't agree, then the judge decides. That's the way it is in any case concerning any matter (bk, divorce, etc) that doesn't involve a jury.

              Does my wife and I have to appear or is it just the lawyers, trustee and/or judge?

                just them. they usually hash it out before hand. the court date is just for them to report the results, if any or let the judge decide i would imagine.

                  If they work the redemption out before the court date you will not be required to appear. That is what happened in my case a week before the court date they (my attorney/their attorney) came to an agreement.
