Bad debt-should I bother fighting since I am filing BK?

    Bad debt-should I bother fighting since I am filing BK?

    I am about to submit my BK forms. I just got a letter saying I owe my former apartments $820, and that this has been reported to the 3 credit bureaus.

    Long story short this was for apt damages that the apartments did not charge within the time frame required by state law. I already sent them a certified letter about 8 months ago regarding this and this is the only thing I have heard from them since.

    Since I am filing BK and this debt will be discharged anyway, should I bother to fight this after the fact? Will it hurt my credit any worse by being on my credit, even though it will be discharged anyway?I think I have a good argument for fighting the charges...but should I just let this go?

    Just to be safe add them to your bk. If you want to fight to get it off the reports at a later time, you can. If you are going to continue renting, you may want to get this off the reports since any landlord that runs the report will see it on there. A landlord might see that as more detrimental than the Bk on your report.

        It will be discharged if it is part of the bk. Any arguments against discharge would be a waste of time.

          stewie, please consider refraining from posting personal information that may be used by someone to hurt you in your bk since you may be using your own name.

          to be honest, if that is the case, i would just bow out nicely without a word and go reregister again under a new name and post questions as needed.

          i just want you to be protected at all costs. this board is well known.

            as for the question, based on your post i think it will be discharged and besd on the amount i dont think they will object. even if they did i still see it getting discharged of course.

            what rib-eating jimh said is right imo, if they put something there that indicated it was a rental abuse situation then it could look bad.

            but, if they havnt put it there yet or taken you to court yet then its too late once you file bk imo and will probably not show up.

            if you dont rent anymore then no more worries imo.

                    I can't imagine any reason for an old apartment debt to not be dischargeable. Unless there was fraud or criminal activity involved...
                    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

                      but you could even get closer search for B. K. Filer instead.

                      look at all these people with B Filer names. im sure one of them would have a K as well. i would hate to be #3 or #4 on the list below however lol.
