    Amending Schedules: PLEASE HELP ASAP!

    Hello again. Ok, I need to do this today.

    I am feeling stuck and overwhelmed, and it is probally as easy as 1-2-3.

    I need to amend a few things from my schedule C. The trustee said a couple of things should not be on the Schedule C, to take them off. Does amending simply mean to make the correction by taking it off? After taking the items off, where should they go? Does it get posted on another schedule? She did not say to amend anything else.

      50.00 Cash on hand that I showed and a 2k insurance check for living expenses that was given to us for evacuating from the hurricane.

        ok at least that info will help someone get you some answers maybe. i had my attorney fill out my paperwork.

        i think the trustee is trying to tell you that you need to exempt those things properly. keep searching for answers until you get some replies here as well. try looking on pacer for a few other petitions that might have done the same thing as you.

          Would you know how to look up other petitions on the pacer. I have never done that. I know how to get on and look under our case, but not the other.

            the schedule C is where you list your exemptions. im guessing he is trying to say you cant exempt those things. everystate has different limits on exemptions but you saying that you even have to take off the $50 and that isnt exempt seems odd.

            i listed my belonging on schedule B. and then i took everything i could exempt and listed it again on schedule C with the codes for exemptions next to it.

            be careful as i dont know what he is saying. if you dont exempt it then he can take it.

              Do a new schedule C, and submit that to the court. I think the issue at hand was there was not an exemption available to you to cover those items, making them non-exempt.

                    Oh, should I bring a copy of the insurance form that shows that it was for living expenses.

                    Am I putting the 2k and the 50.oo in another schedule? She did not say to do so.

                      They should still be on sched. b as assets. If there is no exemption for them, then they wouldn't go anywere else.

                      I don't think it is relevant (to the BK court) what the $$ was for. If you had it on hand at the time of filing, it was an asset.

                        Ok, I was afraid of that. Will they let us pay it back in payments, we used the money for living and paying bills to catch up on mortgage.

                            I'm sure the answer is no. You won't be meeting with the trustee today-just filing with the clerk. I imagine you'll hear more from the trustee, and I have heard cases of working out payment arrangements.
