    Can Someone Please Reassure Me??

    I think I'm just paranoid. But could someone help me to relax? We were discharged in September. On Pacer, it says Case Closed. Our attoreny's secretary told us that our case is NOT closed. I've heard people say, that if your case is a no asset case, its closed the day of discharge. I'm SO confused!

    Also, if ours was a no asset case, and if our case truly IS closed, we can keep all of our return, correct? But, if we've only been discharged, the trustee can take part of the return. Am i understanding this right?

    You're most likely done. If Pacer says you are discharged & closed, then you are. What the secretary most likely meant was that there is a chance of having your case reopened for 1 year. Not likely to happen...

    Even if the trustee wanted your refund, he could only take part of it. You were discharged in July, so you filed in April or earlier? If you filed Apr. 30, he would be able to claim at most 1/3 of your tax refund. It probably was not worth it for him to keep your case open.
    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

      ndbigler, if your case was discharged and pacer also said you were closed then its a done deal.

      a trustee can do anything they want it seems. so why loose sleep over it. spend the money wisely and keep your receipts for it. i dont see anything happening.

      if the trustee wanted the money your case wouldnt be closed. i woudl t ruste pacer way way before i trusted the office.

      if you want a real answer then write a letter to your attorney. he will have to respond. its the law lol.

        Sorry-don't know why I was thinking July... I was busy at work today-had to cut payroll checks and we were a day behind since we were closed yesterday.

          Thanks for the reassurance!! I do feel better now. And I do plan on keeping reciepts if there ever is a reason for needing proof of anything. I suppose if I get more antsy, I'll have some questions for my lawyer, and I"ll write to him
