Well, we're continued until 22 Feb. Thwe judge agreed with us on all points except he wants to mull over the vehicle payments, which total 885/mo, for a car and a motorcycle. I guess it's a bit high, but considering maintenance is included in both payments for the next 4 years, the judge said that may mitigate that. Also, my student loan payment which is coming due in April plays a huge factor. I did not list it on my petition, b/c I was not paying yet, but that would have serious affect on a 13 plan. Stay tuned...

$885 for 2 vehicles is not THAT high. I think the IRS # is around $875. And, having a motorcycle rather than 2 cars means you have less fuel expense...
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
I agree...I can back up the SL payment, though, and I justified why I didn't include it in my original petition, b/c I wasn't paying on it yet and I knew it was nondischargeable, which the judge seemed ok with.
Exactly what we said, Staci, but the UST thinks it's too much...
you gotta wonder why a judge would need time to mullover anything payment related. what was the old fart doing in the meantime while the case was coming due. not doing his homework it seems?
its just a number and he knows what its for. hes seen hundreds of thousands of numbers regarding payments. each payment is taken on its own for the most part. and he cant make a damn decision on the spot?
i would have told him to sit his arse down and figure it out right away...
under my breadth and then said "thank you my lord - enjoy your afternoon sir"

No I tried that for something unrelated to bankruptcy. A DMV issue and it was an administrative law judge and almost told him those exact words when he wanted to continue my case 3 weeks because the investigator was late due to traffic jam. If I spoke out one more time then I would have been taken away. Luckily the investigator showed 30 minutes late and got my case overwith trouble free.
