      I have been living on personal injury settlement money, and credit card cash advance as well. Am I eligible for chapter 7?

        if your average income for the past 6 months is below the state median its a good start.

        remember that the credit card copmany might object depending how long you filed after your cash advances.

        also, know that unless you can exempt the money you do have then the trustee will take it to pay your bills.

        i would seek appt with many attorneys and get questions asnwered. they are free and that is good.

          How long ago were the cash advances? If close to file date, it is very likely they will not be discharged and you will still owe them.
          Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

              how long did you pay on it after the advance? how much was it?

              when was the last times you used your credit card for puchases over $100 or a grouping in a month of $500?

                March 2004 was the last time I used any credit card.

                I have several cards, some are current, some are behind. How much have I paid so far? That will take some time to calculate, but I paid quite a lot, yet the balance is going up. I stopped paying only since this month because I finally decided to file BK.

                  no i dont need how much you paid so far. i was asking how much the advance was for.

                  close to 2 years after using any card is plenty of time to not worry. im in the same boat. anything over 6 months becomes really ahrd for them to go after and if you made payments the entire time you are showing that you meant to pay them back.

                  you are good to go. seek an attorney for free appt and see which one you like.
