    Chapter 7 Questions

    I filed chapter 7 and have received a discharge but it has not closed yet. We did not reaffirm two loans that were secured for furniture. What are the chances that they will not request the return of the furniture? And how long do they have to do that? Thanks for your help.

      Depends a lot on how old the furniture is and who financed it. I believe it is highly unlikely that they will want it, though, unless you just went and purchased it, say, right before you filed or something. I offered to give up my financed furniture and they actually sent a rep to my creditors' meeting who said "Do you even still have any of this stuff?" I said "Yes, but it's not in the best condition. After all, it's 3 years old." He took my contact info and said "Well, if they decide they want it, someone will contact you." I was discharged in late Nov. and so far no one has done so.

      As for how long they have to attempt to get the secured goods back, I don't know if it's up until discharge or until your case is closed I bet someone on here will know the answer. . . .Me, I have one of those lawyers who's never available to answer questions. That is one question that I would like to have asked if I could just catch the guy!

        Yes, it was filed by an attorney and he said that it could go either way. I was really just trying to see what everyone elses experience has been. I was curious how long once your bankruptcy is discharged is your case closed?

          Hello,
          I wrote off Rooms to Go for $6000.00 less than a year after the purchase. Generally they do not want used furniture. We had an expectation of a LARGE salary increase that did not materialize. They never contacted us in any way. What amazed me was that MBNA was owed $17,000.00 and they didn't even show for the meeting, no one did.

            Just so you'll know, our BK (first ever) was a nightmare, God willing I will NEVER walk that road again. I went from a 770 rating in Feb. 2001 to BK 7 in less than two years. Some bad decisions. Decided at the last to file. HATE DEBT ALWAYS.

              Yeah, I hear ya, Robivi. From here on out if I can't pay cash for it, I'll do without it! :o I didn't have that much debt post BK; have never been an extravagant person, but it was enough that when my daughter got sick and I actually started missing work for the first time in my life, I fell behind.

              Texas2005, your lawyer is correct- it could go either way with the furniture. Odds are against them taking the furniture back, though.

              I still don't know how long between discharge and closing. Anyone?
