    Filing and a new creditor

    OK, I am helping a relative file BK ch7.

    Paid 199$ for preperation, and ready to go to the courthouse tomorrow and file. Will cost more money to amend the document.

    Problem: National Credit Adjusters just "bought" one of the credit card debt from Providian. They claim they own the account and have an investment in it.

    Does she need to amend the BK paperwork to include this creditor? Or since the underlying debt with providian is in the BK, is she covered?

    shes actually covered since you already filed. its your best faith effort.

    but if you want to include it then it just protects you better in the long run.

    its worth the extra $26 or whatever the new fee is. that fee is assuming you did file already. if you didnt then just be sure to add it along with the other papers.

    remember to list either that one or the new one without a balance and title it as 'duplicate of providian' or something to that wording imo.

      So we had the documents prepared by a service and it is all nicely typed. We are planning on filing today. Would it be bad to just handwrite them in? since it does not change the $.

        i dont think that is a problem as long as it is very clear. call the court and ask though.

        all they do it photo copy the documents into the system.

        but isnt there a requirement to have the creditors list on a floppy disk? i cant remember how it works to pro-se.

          Some things vary by district-I didn't have to turn in a disk.

          You should be ok to add a page, or add it to the bottom of the last page if there is room.
          Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

            lots of attorneys are now filing via internet.

            i would hate to think that someone has to type in all the names, addresses and account numbers for each filing lol.
