    Remaining(property) Judgement 2 years after filing chaper 7

    Hi, maybe someone here can help me. 2 years ago I filed chapter 7 Bankruptcy. And received a Discharge. Now I went to refinance my house and I have found out I have a Judgment Against me. After researching I found out that once I went to counsel about bankruptcy and was filing. One particular Credit Card (Providian Bank) Sent a Lawyer (Edward Bukatey III) down to the court house and filed a judgment against me and it has a property attachment to it. Now they did this days before my filing and I was not aware of this. So I filed Chapter 7 and received a discharge. Now I went to refinance my house and they say I cannot do it until this judgment is settled. Due to the fact that he did this before I got a case number. Even though the law firm and the credit card were included in the bankruptcy. I called them and they will not settle for anything less than the amount of Judgment plus 25%. This comes out to a whopping 8300.00 bucks. And the law firm is not friendly and rude. Now I do not have this much money and am in need of desperate help. Only I do not know who to contact. please email me if anyone here has any advice!! thanks!!!

    Something sounds amiss. You can't just walk down to the courthouse and get a judgement. They have to sue you first, serve you with the complaint, and give you time to answer the complaint (time varies from state to state, but its usually 20-30 days).

    Technically, if the judgment pre-dates the date of filing, then it is presumptively valid, and judgments pass through a BK unless they are expunged by motion to the BK court.
