    Garnishments and judgements with chap 7.

    Can any creditors garnish your paycheck after you have told them you are filing a chapter 7, and also can they put a judgement against you also ? Oh one last thing. We are behind on our car payments :o should we tell them that we are filing chap 7. We are afraid that if we do they will automatically tell us to turn over the cars. Respond soon. Thanks.

    Hi,

    A creditor can take all legal/collection action neccessary against you until they recieve your STAY goes into affect. If you're behind on your car payments, and plan on keeping the vehicle, contact the lien holder ASAP, and see if you can simply make half or partial payments to prevent them from trying to recover the vehicle. Depending upon home for you are into your finance term, and other criterias they have regarding this. They may or may not accomodate do this.
