    341 Completed Today...

    Well the day has now come and gone.. The 341 meeting is now a part of history..

    I have spent countless hours reading about others experiences and must admit it was not nearly as bad as I thought it would have been thanks to these boards and to those of you who have posted your experiences. To that, I say THANK YOU!!!

    The meeting was at 3PM and I arrived at 2:15Pm to sit in on a few meetings to see what they were going to be like. My attorney showed up shortly after I did as did a representative from Bass & Assoc. Tried to get me to sign a reaffirm on the spot but I refused and told her that my attorney and I would discuss later. He agreed that was a good and solid move.

    At approx 3:20 the trustee called my name and after presenting ID to him I was sworn in and he asked the standard questions everyone else had posted. There was one slight moment of tension when he asked a question regarding the means test but my attorney wquickly took care fo that and all was done. I would say it took all of 5 minutes but seemed like an eternity.

    As we walked out of the meeting room my attorney said that the worst is now over and the only thing left to do now is to complete the 2nd test and await discharge.

    All I can say is WHAT A DAY!! So glad to be past this hurdle..

      Congrads.....................your halfway there now.....

      Just wait out the next 60 days and try to be patient.......

      Hopefully you will receive your discharge after 60 days and you can get on with your life and rebuild your credit...

        Congrats!

        Keep in mind that if you decide not to reaffirm, the automatic stay ends before discharge. I've read 'no more than 45 days' though that is a little vague as it could mean it would end sooner. Not an issue if you're current, but something good to keep in mind regardless!

          right now all debts (three of them) that I will be reaffirming ar current and no worries.

          I just checked pacer and found this entered today..

          "Trustee's No Distribution Report:"
          I, the trustee of the estate of the above-named debtor(s), report that I have neither received any property nor paid any money on account of this estate except exempt property; that I have made a diligent inquiry into the financial affairs of the debtor(s) and the location of the property belonging to the estate; and that there is no property available for distribution from the estate over and above that exempted by law. Pursuant to FRBP 5009, I hereby certify that the estate of the above-named debtor(s) has been fully administered. Wherefore, I request that this report be approved, and that I be discharged as trustee. This report is signed and submitted under penalty of perjury.

          Sounds like this is a good thing? Does this normally happen the day after the 341?

            Timing will depend on the trustee. Having it filed right after the meeting is good, but if it didn't get filed for a week or two that wouldn't necessarily be a problem sign.

            It means you have nothing that the trustee thinks he can get, and he isn't going to investigate any further. At this stage, as long as there are no transactions that the creditors could/would object over, you should have an uneventful road ahead of you. Just stay in touch w/ your attorney regarding those reaffirmations-he is handling many cases yet you want to make sure he doesn't overlook yours. Beyond that, complete the last required class and mark days off your calendar.
