    We were Dishcharged today!



    I am so happy we are discharged. We are disappointed that I called the trustee and asked to please hold off for a couple of days until the mortgage lenders sent our reaffirmation forms (took their sweet time and never sent out the first time I called). They overnighted them to us and the trustee discharged before we could get to the courts tommorrow to file the paperwork. I hope this will not hurt us.

    On one part of the pacer it says awaiting trustee report. So we really do not know if we need to send her any money yet. It was a no asset case.

    Can someone please explain this statement by the chapter 7 courts:

    Debts that are not discharged:

    Debts for which the debtor has given up the discharge protection by signing a reaffirmation agreement in compliance with the Bankruptcy Code requirements for reaffirmation debts.

    What now? Do we wait for something in the mail?

    If you reaffirmed a debt, it would not be discharged. Meaning you would owe it, and be contractual responsible for it.
    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

        rimi2001 I am in the exact same position. I am discharged with a no asset case waiting trustee's report.

        For any of you who recognize my name or followed my details, I am REALLY sweating bullets about my Roth IRA. Since I filed under the old laws the Roth is not explicitly exempt and to this day nobody can give me an answer. I check PACER daily in hopes that it just goes through and that those clowns don't wait until the last day to send me a bill for my $20k Roth IRA.

          Sorry to hear about the problem with the Roth IRA...... hope it is protected by exemptions and they don't take it from you......

          Time will tell, just hang in there, and hope for the best....
          The fact that your discharged is a good sign..... I'm surprised the Trustee hasn't inquired about it since that is usually taken before discharge..

          Soooooo, here's hoping they leave it alone for ya!!!
