    ?? Case Closed, what about tax refund?

    I just checked PACER and it says my case was CLOSED on Feb 22....WOO HOO!!

    BUT, I have not heard word one from our trustee regarding our $3500 tax refund..I sent him copies of our return like he asked for. Long before our case was closed. Shall I assume he's not taking any of our $$ since we haven't heard from him and the case is closed?

    PLEASE HELP! I have plans for the $$ if it's ours

    No news is good news but, I'd ask my attorney. $3500 is enough to get a trustees attention.

      The most important thing of all - did you send him your refund CHECK?????

      If you still have the check, and it says case closed, then he may not be taking it from you............

      If your refund was large due to the child credit there's certain parts of the income tax refund he can't seize. And he can only seize certain months that your were in BK.

      He should be sending you a memo on it anyways.... either yes or no whether he's taking it.

        I didn't send him our check (we got our refund by direct deposit)...he only asked for copies of our return. We have 3 children, so we have some credit there......and we filed BK in Oct so how much would he take if he WERE going to take some?

        Also, my attorney is a worthless P.O.S. and I have only had minimal contact with his paralegal and zilch with him. I am completely amazed that this entire process went as smooth as it did considering..........

          You may strike it lucky and he's not going after it since your case is "closed" - not just discharged...

          If you can't get an answer out of your attorney contact the trustee's office and get an answer from them.

          If he's going to get any of it, it won't may any difference if you contact him or not.... at least you will know for sure....

          Hopefully the majority of your refund is exempt and that's why you've not heard from him...

            OK....I am totally confused.......today I received notice from the Trustee that we owe $1100 from our refund...from everything I read on here, I thought that they couldn't take your money once your case was CLOSED (which mine was 2/20)

            SOMEONE please help me...I am getting nothing from the POS attorney of mine.........
