    I dont know for sure and hopefully someone else more versed in tax situations will, but there was a person who posted with a similar problem. I recall the trustee said if the proper tax was withheld they would have more disposable income so he made them convert to a Chapter 13.

      As I have the opposite situation, as I am underwithheld. It will be interesting to see if the Trustee acknowledges that if the proper tax was withheld I would have less disposable income. This would further secure my need to file Chapter 7.

        I think that's a situation that can be reasonably explained to the Trustee. An adjustment of withholdings after realizing you would owe taxes next year does seem reasonable and logical.

        Definitely run that by an attny before proceeding. But it seems to me that it is a reasonable explanation for your situation.
