    Need your help on something!!

    Hi all...

    Was looking at PACER and saw this online today..

    The United States Trustee (UST) has determined that the debtor has not filed nor transmitted all of the required means testing documents and that without these documents, the UST cannot make a determination as to whether debtor's case is presumed abusive under 11 U.S.C. Section 707(b). Filed by Leroy Culton on behalf of Office of the US Trustee.

    Appears that this is nothing bad, just that the attorney needs to confirm or resend some information to the Trustee? See the reply below and tell me what you think...

    Its stating that the US Trustee cannot make an correct assesment of the debtors status without the proper paperwork being submitted. Thus would result in a dismissal at the 341 meeting.......

      If I read it correctly, some part of your Means Test is missing, or may not have been filed properly to begin with.

      Maybe your attny needs to resubmit the Means Test in it's entirety.

      Could be possible that your attny filed the wrong Means Test. There is one for filing Ch 7 and another one for filing Ch 13.

      If the error is not corrected before your 341, your BK could get dismissed, as Minny said.

        gacreditguy...to the contrary it could be something bad if the problem is not cleared up...specifically your case will be dismissed at or before your 341....

          well, I already had the 341 meeting on the 6th or March.. Just got this notification on the 24th and the attorney said that he would be looking into this immediately to get it taken care of.. he said that it is likely some information that needs to be resubmitted to the trustee as there may have been an error on it..

            UPDATE!! My attorney did confirm with me today that the updated paperwork was submitted in its entirety.. Said I have nothing to worry about that the case would not be dismissed.. Basically, he told me to "chill out" in no certain words.. LOL

            I so so nervous and freaking over the tiniest things right now.. I just under 30 days (5/6/6) from the dealine for objections is and then it will be discharge time..

                you have no idea how good I slept...

                I am the "worry wart" from hell and even though I knew he would make it right, I was on pins and needles..

                Nothing like a little paxil and ambien to get me through this stuff...
