    Have a question about breaking a lease.

    Hello everyone ! I am new to this site and have a question may be someone can help me with. We have been in the market for a new home since the BK was d/c in Jan. of this year. We have found a mortgage person that will do 100% financing since we have a middle score of 580...We signed a 12 month lease in Jan. of this year for a house that I HATE !! It's on the beach (very loud) and the rent is VERY EXPENSIVE and actually a house payment would be cheaper for much more square footage..I talked with my realtor and she said to just call the company that I am leasing the house from and give them a BS story and tell them I want to break the lease because of the noise factor...i am really worried that they are going to try to sue me or something..I am so scared of anything financial since our BK !! Anyways just wondering if anyone has ever broken a lease to buy a new house and if so what did you tell the landlord ??? Does this question even make sense ?? haha !!

    My apartment development which is owned bty the large company Aimco is very hard line. 60 days notice and a one month's rent penalty on top of that to break a lease early. They won't budge or listen to reason.

      If you include it in you BK you can get out of your lease...
      My credit scores:
      Before Filing: Tr 496, Ex 496, Eq 507

        I assume you live in tallahassee? Anyways, you can try what the realtor told you. And you can get out of it regardless of what they say. But the bottom line is, its going to cost you. Your security deposit, last months rent if you paid that, or if you didn't they might want an extra months rent before they allow you to break the lease.

            I live near Cocoa Beach, Florida laws are in favor of the landlord. I'm guessing that the lease you signed stipulated that if you left before the end of the lease you owed the full term of the lease? One angle to pursue is if the property is not properly maintained you can begin to notify your landlord of the issues that need attention on his part and keep detailed records, like copies of certified/return receipt letters of notification of issues and also exactly what the landlord does in response. If beach houses up in your area are anything like the ones here, except for the ones made in the last decade, most need improvements such as being up to date on hurricane codes, being poorly insulated, poor air conditioning, etc. You can even get you local power company to do an examination of the properties condition as far as the
            electrical utilities consumption goes and see if they think some updates would be in order to save on utilities, then pass that on to the landlord as something that needs to be addressed.
