    Living in the Shadow...

    ..of the trustee is just bugging me.

    We have a ch7 asset case, discharged in December. We came to an agreement with the Trustee over buying back a couple assets, and he gave us 12 installments. I figured this would start in January when the verbal agreement was made.

    Here we are in April and the trustee still hasn't sent paperwork to our lawyer for us to sign. On the one hand I want to call and ask about it, on the other hand I have a pipe dream where he forgets about the assets and closes the case.

    At our 341 he asked us about our taxes and when showed him what we usually get back he indicated he wasn't interested. I hope he keeps that attitude. Our income ended up being a lot less than normal this year and we are getting a lot bigger refund. If he wasn't interested last October, and we haven't heard anything as yet, are we pretty safe?

    What to do, what to do about the buyback?

    Don't rock the boat, let the Trustee come to you over the buyback... Did you have an attorney - if so, he needs to be handling this....
    If not - sit tight - don't mention the income tax refund.....

      We do have an attorney. I was thinking of calling him, but I hate to draw attention to our case. On the other hand, it won't be closed until the trustee abandons the assets or we pay for them...

        The trustee may be waiting for you to pay for the assets.....
        Might be a good idea to touch base with your attorney - just don't mention any tax returns...... since they haven't....
