    Wife wants a divorce to protect her side, does this work!!!!

    We bought a house in november. I am filing separately, never had anything together as far as credit cards or bank accounts. She has filed 5 yrs ago, and a lawyer said that creditors could go after her. Is this right?
    We want to keep the house, would a divorce help it out or make it worse....

    The only way you could really be affected would be if you are unfortunate enough to live in a community property state. Where do you live ?

      1st you need to sit down with an attorney.
      Yes, creditors can go after her if joint accounts, since she filed before....
      If the home is the only thing you both have your names on, you can file separately and reaffirm with the mortgage company on the home.....
      Do you have a lot of equity in the home having just bought it?? A big downpayment?
      A divorce would not solve the problem, only make it worse.....
      If you file and she reaffirms on the home, shouldn't be a problem in keeping it..... it will become her debt..... as co-owner.
