    need help about motions

    Me and my wife already went to the 341, the trustee wants to see our life policys so i made copies and gave them to my lawyer. he filed them under exemptions. now ive recieved 2 motions in the mail (1) motion for extension of time to object to exemptions and (2) motion for extension of time for filing complaint to withhold discharge, we filed chapter 7.

    What does these mean?? thanks for the help

    Who filed the motions?

    Obviously, since I haven't read the motions, I don't know what is in them, but if all they are asking is for an extension of some deadlines, that is not too big a deal. But it depends on who filed the motions and why. In a BK everything has a deadline, and in nearly all cases, if a deadline is missed, then there is nothing that can be done by the party that missed the deadline (for example, in a chapter 13, creditors have only so many days to file a proof of claim, if they miss the deadline, their claim is barred). So someone is bascially asking to extend a deadline to consider some options.

    The fact that someone went to the trouble to file these motions is probably not a good sign, but it is just as likely the filing of these motions is merely procedural because of the additional info requested by the trustee.

    Although dealing with these motions is probably outside the scope of your BK attorney's representation, you should discuss it with him/her.
