    341 this Friday

    My 341 is this Friday, YIKES!! I am terrified...I know you all told me no sweat, but I can't help it!!

    Would I have been notified if they needed anything else by now? Do I bring anything with me besides my license and SS card? I plan on bringing all my copies of everything with me, but I was thinking of leaving them in the car. Just in case they ask for anything I can run and get it???

    My hearing is at 10, so I will be there for the 9 AM starts so I can get some information under my belt!!

    My 341 is this Friday also. My mortgage lender (seller financed) filed a Motion Lift Stay Monday but he failed to notice me and the trustee. I'm afraid he is going to show up and cause me problems. I am the first one at 9:30. I plan on getting there at 9:00 also so that I can hear how he (Trustee) does things.

      I answered that one in your other thread NM.

      Mortgage Lenders do that all the time so they can Foreclose and get the Deed in their name to resell the property. It shouldn't cause you a problem at all.

        You'll discover that your 341 will be a breeze, but I know that doesn't help to be any less stressed before it happens!

        As for having your documents, did you file Pro-se? If so, then I would DEFINITELY bring in all the documentation you have. Although it is likely you'll not need it, you'll want to be prepared in the event the trustee asks for something, because you will not be able to go and get it. As you'll see during your meeting, there will most likely be a lot of other people waiting for their 341, and the trustee will not want to wait for you to go get your documents. Instead, he or she will continue your case and you'll have to come back in a month.

        If you have an attorney, he/she *should* have all the documents that will be needed, but unless you are supremely confident that your attorney will have everything in order, I would recommend bringing your copies along just to be safe. It may be a pain to lug them around, but it's far better than the alternative.

        At the very least, be sure to have a copy of your tax return. Of the 20+ meetings I watched while waiting for mine, the trustee asked for it EVERY time.

          I'll second this. Bring all of your own copies of paperwork, and just watch the others who go before you. It's nothing to fear, and it will end before you know it.

            Dont worry, its a cinch!!
            Here is what we were told to bring:
            1. drivers license or other official picture ID
            2. SS Card
            3. copies of most recent tax returns
            4. copies of last two paystubs

            Make sure what you bring really are copies, because the trustee will keep them. Everyone before us were asked for all these same items, so I would bring them just in case, and I wouldnt leave anything you might need in your car.

              My atty has my tax returns. I assume he will bring them, but I will bring my copies with me. I will also bring my check stubs from the past few weeks also. Thanks for the heads up.

                  Good luck Annika! I had mine today and it was short and went fairly well. Just try not to worry too much about it because it will be fine.

                      Thanks for all your support...I am still nervous as all hell!! I can't wait for tomorrow to be over with...it will be the hardest part of this process for me! I think I will be able to relax after that! Thank goodness my time is at 10 tomorrow morning...I'll be able to watch a few before me, but I don't have to stress about it all day!! And if all goes well, I think I will treat myself to a nice lunch!! I'll report my experience tomorrow!!

                          All Done!!

                          Well, after watching about 10 people go before me today I thought what a breeze this is going to be...but my atty was so unorganized with some of his other clients before me...got me real scared. He tells me when I get there that we have one of the harder trustees...great...then I have to watch the trustee scold him because he is wasting valuable time by not having all the forms he should have for the THREE people before me! Oh boy...I'm thinking I'm doomed for sure! I get up there and sure enough, the appraisel on my mobile home is not complete enough for the trustee. Atty blames everything on his staff and apologizes over and over again. Luckily I had a copy of my mortgage statement and mortgage deed with me so that helped a little bit. Atty needs to forward him copies of appraisel and the trustee said he would dismiss as a no asset case! Yahoo!!! So. you bet I will be on the phone Monday am to make sure they get this done ASAP!

                          All in all, I was nervous as expected but it really wasn't necessary as you all told me! Once it finally gets started it does really only last for a few minutes, but it sure does feel like forever!!

                          Now I wait....

                            That's great that your 341 is over, although it seemed like it would be rough at first. Its a good thing that you was prepared with a copy of your necessary paper work. Seems like your atty needs to get it together. I hope that my 341 goes smooth next month and that I don't have a mean trustee. Now is the 60 day wait but it will go fast.
