Filing Petition Timeline

I hope this is an easy question. Say I was to go and file the petition myself and pay the fee for a Chapter 7. And I provide the list of creditors (matrix I believe it is). Then would I have some days to actually file the rest of the paperwork and perhaps find a lawyer? I am seeking this automatic stay to stop two banks and think a short time span may help me a BUNCH!

I'm pretty sure you have to submit the entire filing at once. But the forms are the easist part! It took me less than an hour to do mine on the computer.

It only took you an hour? Did that include your full inventory with prices? So if the forms are the easiest part, what is the hardest part.

On the inventory of Household goods,.........

There's only 1 attny here that's including an entire household listing of items. The rest of doing "group" listings with a $ value. They break out only what is necessary and required by the forms.

Also, there's a Sticky up top of this section of the Forum, Ch 7 section, titled "What Trustees Look For". That thread has a link to a website with lots of stuff highlighted, pointed out, and explained for Trustees. You might wanna take a look at that website.

Wanted to add,........... There's been a couple threads recently with links to websites with on-line editable forms. Use the Search function, find those. Maybe you can fill out your forms that way.

Also, the Court likes to have the Creditor Matrix done on disc. There might even be a preferred format. You could call the Clerk of the Court to see. That way they pop in your disc to generate the letters to the Creditors. Rather than having to type everything up themselves.

Just remember, you must take your course and have the certificate issued BEFORE filing.

Yeah it took me 30-40 minutes. The hardest part, was gathering all the information, pulling credit reports, gathering bills, which I all did in the week prior to the doing the forms. Then after I was finished, worrying and obsessing over it for about a week.

You will need alot more than a list of creditors. Pre-Bk credit counseling, and they don't take any reasons I'm told for not having it completed.

Some lawyers will do it for you rather quickly if your in a bind. You should contact one quickly. Since from the tone of your message, something with a couple of banks is about to happen against you, you should probably see a lawyer quickly.

What ever the banks do will stop at filing, all lawsuits etc will stop as soon as you file. have everything is the best advice I can give.

I did it!!!! Just finished pre BK counseling online. What a pain but it is over.

Just need to work on filing out the papers. Still a bunch of questions though - I'll still be here - believe me!

i'm fairly sure that if you plan to be under legal counsel during the petition process you need to have the lawyer prior to filing, otherwise you would be pro se.
