    Help! Proposed Abandonment

    I just got home from work and found a "Notice of Proposed Abandonment" for my house. It says the liens on the property to be abanonded and lists the mortgage. I'm confused. I was supposed to be keeping my house and mortgage. This notice is dated for the 22nd of Jan. and my bankruptcy hearing was on January 20. Of course, its too late at night to call the attorney. Does anyone know what this means? Thanks.

        My understanding is that the Trustee is abandoning his interest in your home. It is when he files a motion to withdraw the abondonment that you have to worry.
        In other words he is saying that interest in your home is not sufficient for him to sieze a portion of it.

        Now this is from my own BK regarding my Automobiles (in Florida they can't touch your home in any way). When he abandoned interest in my Autos that was good, when he rescinded the abandonment that was bad.

        But by all means speak to your Attorney, he will give you the best rundown. he is the authority on "Legaleaze" in your case.

          Thanks! Your quick responses have put my mind at ease. The form I received was not as clear and concise as I would have expected. Unfortunately my attorney did not warn me to expect it. I was so nervous when I opened it that all I could find online was this site!.. Thanks!! I'll confirm with my attorney in the morning. (At least I'll sleep tonight)

            OK, now I am confused. We retained our home and mortgage along with our truck and its loan in our ch. 7. We have already been discharged but we never received one of these notices. Is this always done? Does this mean there could be a problem with these loans and my property now? Or is this just customary in some states and not in others? Please help me figure this out. I guess I am just so scared that even though we were discharged that we missed something or that something is going to sneak up and throw my world into havoc. Its just too good to believe that we can move on with our life.

              Each State is different. We never recieved notice Re: our home because in Florida the home is untouchable. We never recieved notice regarding our truck because it had payments. We recieved the notice regarding our car which is owned free and clear. He then vacated the abondonment and came after us.

              I understand the panic these notices cause, I went through it. We have to learn not to spend time waiting for the other shoe to drop. It is hard, I know.

              PRAY THAT THE TRUSTEE ABANDONS ALL INTEREST IN YOUR PROPERTIES!
