    What happens to your assets after discharge?

    While I try to figure out whether my home and car were in fact reaffirmed (read my previous post), I find myself with a lot of questions.

    If in fact neither my home nor my car are found to be reaffirmed, and as both creditors were listed in the bankruptcy (which is closed and discharged),
    1-What happens if I stop making payments on the house? if it's discharged, don't I no longer owe anything on it?
    2-Same with the car - if I stop making payments, what can the finance company do to me?

    Seems to me I could just stop paying on both and spend that money on other stuff. Sure wish my lawyer would call me back......

    You filed New Law so myabe the attny didn't file the Reaffirmations. Evidently the attny has to sign the Reaffirmation Agreement under New Law. Maybe he/she decided not to.

    If that's really the case,........... As long as you continue making payments everything will stay the same.

    If you aren't reaffirmed and you quit making payments, the auto lender will move to repossess your car and the mortgage lender will move to Foreclose on your home. Depending on the State, will decide how long you can stay in your home before you have to move.
