Banks, Sheriff, Judgements - OH MY!

    Well I'll be!

    I just discovered that in Pennsylvania they CANNOT garnish our wages except for child support or taxes. So if this bank pursues this and gets a judgment they are going to come take my junk, sell that at auction, and still not get anything except a hassle and the satisfaction that they have bled me dry. How do they sleep at night.
    I have a hope that they will just drop this once they find out we are qualified for no asset bankruptcy and have contacted a free legal aid office. Do you think they'll figure it out?

      They probably will not drop it until they get your bankruptcy notice. Reason is that although you may not have anything of value now, you might in ten or twenty years...they can satisify the judgement then (and include interest and all collection, court costs)...

        I remember looking up PA for someone else recently. They, the sherriff, can literally come in, do an inventory of your household things, and sell off your stuff until the Bank gets the money. PA is harsh that way.

        Some Creditors I've told have updated their files and aren't calling us any more. They've contacted our attny and verified that we've retained him, what Ch we're filing, an anticipated filing date, and they're leaving it at that. Other Creditors continue to pester until we actually file and physically have a case number to give them. Different Creditors, different proceedures.

          Holding Breath

          We filed our motion for continuance papers until we could get an attorney. Asked for 60 days, I hope we get it.
          We figure we need time to get all the information ready and some money saved to be able to hire a decent attorney and pay the fees so when we go to court we may be able to cabash (sp?) this thing - nip it in the bud, file the Chapter 7 and move on with our lives.
          If we get about 3 months to straighten things out, perhaps get the bank to consider that it sold our trailer for WAY too little, we can wrap this up.

          Keep your fingers crossed for us! Thanks to all of you - I'll be hanging around for a while!

                  We are all concerned about your situation and the problems that you are encountering.
                  Unfortunately, we have a member or two on the forum that "likes" to make remarks about others "problems" and often "jokes about them"......

                  WELL, AT MY HOUSE, bankrtuptcy was not a laughing matter, or a joke, it was taken very seriously and with very serious results......

                  Qg, has a sense of humor that many do not appreciate nor desire to hear..... so just take it with a "grain of salt" as my mom used to say....... Just consider the "source".......

                  Besides - "he's my pet project" this week...................

                      Looks like the court doesn't care too much about the little people. We requested a continuance to find a lawyer and were DENIED! They sure rushed to give the bank their hearing for a summary judgment. Well, we have to do some hearing on June 15 and the motion for summary judgment will be on June 30. But, on May 26 we are meeting with a lawyer to file the official bankruptcy papers - no point putting this off anymore, tired of the sleepless nights. But soon I'll be able to say - FREE AT LAST!! FREE AT LAST!!
                      We returned to an original attorney that hadn't been returning our calls but was a real good price, he appears to have a heart which the last one didn't who made us feel like we were commiting fraud. He told us to "bring our fraudulent little selves" to the meeting - a sense of humor will really help right now.

                      I'll be here until we're discharged Thanks to you all, I couldn't have made it to this point without you - you've had more compassion than my own family
