I filed Chap. 7 and found out i have too much equity. After paying everybody and my exemption, there's about $54k. The trustee said he would take half of $54k and use it to pay the creditors, therefore leaving me the other half. Can the trustee do this? and Can I or my attorney negotiate to have the trustee maybe take less then half to pay creditors. My attorney has been avoiding me pretty much. he rarely ever returns my calls.

Sorry, I really don't know what to tell you. You might want to fight the value that was assigned to your house. I would think your attorney should have warned you that you could lose your house if its worth that much.
Yes, the trustee can do it. At this point, you may want to attempt to voluntarily dismiss your case.Comment
