I am so frightened & overwhelmed

I am in my thirties and so far in debt it is scary !!I have tried credit conceling for almost a year and I did really well paying the agreed amount for about 6 months BUT NOW I have fallen so far behind that BK is the only option. I am just looking for some comforting words to let me know that it will be OKY and that filing is NOT the end of the world... thanks so much

Most people who have posted on this forum that have been through a BK express the feeling of relief as a "lifting of a giant weight off their backs". BK is your priviledge under the Constitution of the US. No one is going to yell at you in the BK court. Go see an attorney to explore your options and good luck.

I can't agree more with HHM, the relief you will feel is as overwhelming as the fear and worry you are going through right now. Schedule a consult with a good lawyer so he can explain your situation to you clearly so you can see what the future holds and what the process entails. No one goes out into the world saying "lets see how much debt I can rack up". Situations arise and we find ourselves in places that we never thought we'd be in. It doesn't mean you are a bad person and it doesn't make you any less of a person. You can get past this. I must say you are a step ahead of myself in that you have found this forum. I wish I would've known about it long ago and could've saved myself from so many unnecessary fears. Good luck.

Thank you both for you help! I appreciate it! I guess the unknown frightens me. I own a home but I have only owned it for two years ,the morgage is on time each month, there is obviously no equity in it.... I just don't want to lose it! Will I have to sell it??

Probably not, so long as you can keep making the payments.

Relax, Shygal. :o I think it's been the best decision I ever made, quite frankly. It was a huge relief. I'm sure you will feel the same way.

I was in your shoes. My husband and I tried debt counseling for three years and debt consolidation for six months. Things were going well until I was laid off. We ended up filing for BK in December, and it is such a huge relief! We can start over! You will be okay.

Thank you everyone for your kind words.... I am just wondering if there is going to be any type of problem with the fact that I used 2 of my cc for very small purchases last month ( under 100.00 each)? All of the other cc haven't been used in over a year !

It sort-of depends on what you bought. If you bought groceries or necessities or paid a utility with it, then it should be no problem. I doubt it will be a problem anyway. When I had my 341 I don't even recall the trustee asking anyone what, if anything, they had purchased on credit recently. Of course, that was my unique situation and yours could be different. But I suspect you'll be fine.
