    payday advances

    I have 3 payday advances out and i'm thinking of filing. i don't want to pay them how long do i have to wait until i can claim them in my bankruptcy? Is there a way i can not pay them and keep my checking from being ruined?

    When did you first take out the payday loans?
    If you don't pay, they'll keep chrging your bank account until,the bank closes it and leaves you with a bunch of OD fees.
    You likely need to open another account at a new bank.

      i did open another account. i've been doing those three advances for atleast 4 months now. but i renewed them on 6-16. i've heard something about having to wait 70 to 90 days

        Payday loans are treated like cash advances. The longer you can wait before filing, the better.
        Since it's been 4 months, I'd just stop paying and go ahead and file.

          Yep! Keep is right. Payday loans are not considered cash advances for BK purposes. They are unsecured, personal loans.

          If you don't have any CC use in the 79/90 day time period, Cash Advances/Charges,........ You should be fine to not pay the loans and go ahead and file.
