Amemding a filing...

    They were pushing me pretty hard to amend that's why i'm not! I have a bad feeling this could go south and cause me more problems then I really want to deal with! My filing will stay as is... Plus I'm not putting out the extra cash that requires
    My credit scores:
    Before Filing: Tr 496, Ex 496, Eq 507

    Today: Tr 618 (+122), Ex 601 (+105), Eq 623 (+116)

      Most of these companies can be very harrassing on the phone but when it comes to "paying the legal expenses involved" IT'S A WHOLE NEW BALLGAME........ they just end up writing it off.........

      I wouldn't let it bother me much, just at it to your creditors list and

        If you don't add them to your list, then they can file suit, and attach a lien against anything you might own or will own in the future..........

        $75.00 is not much spent when compared to all the problems of not including them can cause...... plus the expense of hiring your own lawyer, etc......

        Don't make a grave mistake by not including them...............

          It's like $300 I doubt it... Maybe I'll call them back after my dischage, and see if they'll take $.50 on the dollar to settle the debit. It will be take it or leave it...

            You might just tell them you have filed BK and give them the case info. They may look to see if you filed, but they may not check the creditor list. Even if they do they do, they know you can get them added anytime you want so they may just drop it.

              Tired that no go...They will just have to wait. They will not come after me for $300.00. I'm not worried.

                I gotta ask, Nascar,...........

                Is this a smaller Creditor?? Like a Mom and Pop type place?? If so, you may wanna think twice about not adding them and discharging them.

                They probably won't settle for half on the dollar. That small an amount, they can come after you in Small Claims Court and win a Judgement against you for the $300 + filing fees + any kind of imagined damages up to the limit of Small Claims Court.

                When we were giving the paralegal all our info, we chatted a bit about the 341 Meeting. I asked her if any of our Creditors would be there. Nope. All of ours are "biggies". Nationally known CC's. She said the Creditors that show up at 341's are local Creditors. She proceeded to rattle off a list of people they see on a regular basis at the 341's.

                Local Creditors can be very pesky. Down right pests. Best dealt with by discharging the debt. Think about it. You say "Only $300" when you may be discharging $10K to BoA. But it's not "Only $300" to a Mom and Pop type Creditor's bottom line.

                Just some thoughts for you. While it may cost you $75-$100 to add this Creditor, there's no price you can place on the value of not having to deal with the BS factor by discharging the debt.

                  Here's the thing.. this was passed to them in 2003 and thye just this month put it on my report! I say screw'em. I called them to get the information on the account and they refused to give it to me. So, if they want to take to me court they can explain to the judge why the refused to help me when I called them. and why it took 3 years to process a $300 debt. I'm willing to go as far as I have to on this one, but my current filing will stay on track. They will have to wait till I'm ready and able to pay them. I don't have the money to pay for the amendem anyways right now.
