I would try not to rent from someone like that to begin with if at all possible. I called about an apartment recently, and when the lady started asking me all kinds of personal questions I just hung up on her.

Just start paying your parents a monthly rental fee for your space at home. Mom and Dad will appreciate it A LOT.. Also, if you are good they may be nice enough to put that money into a savings account and you have it after all is said and done, but that is TOTALLY up to mom and dad and do not ASK them to do this! You do not want to let the Trustee get the whiff of fraud going on..Thanks,

I like this idea the best, as I mentioned it earlier ;). I think if mom & dad use the money to improve their home that too would be good for the original poster.
I also agree with scammer. This is too much work and too much risk for a temporary solution.

Okay, you guys all win, you have all identified examples of subletting. I have been an active member with the Dupage County Property Owners Association, and in over ten years discussing all kinds of things, never once had it come up in our meetings. Guess I should have said, "no property owner exercising good judgment, would allow the original tenant the ability to enter into contracts with others for the sole purpose of subletting".Originally posted by FilingOnMyOwnI lived in someone else's apartment for a year. I have very updated properties, I am not willing to risk having an individual that has not been screened move into one of my units. I can't afford the possible total loss or destruction of carpet, appliances, drywall or missing stainless steel appliances that can happen by not properly screening. I have very very little problems with tenants, due to the fact I have a security deposit and there good credit signed to a contract. I pride myself on keeping my townhomes and condos extremely nice, so that typically one of the first people through snaps it up and rents it. I guess if my properties were of average rental quality my neck wouldn't be out so far, and the risk would be less.
I probably should not have stated subletting doesn't go on, I have a buddy who owns a frat house in Iowa City, the floor has a wonderful small of beer hopps from all the gallons spilled in the place, I guess if someone subletted who would know??

1. If I start paying them rent this month, when should I file? Should I wait several months so the trustee sees that I have been doing this?
2. When I meet with a Lawyer will she/he not advise of this since they are not allowed to give me any pre-bk planning?
3. A rent payment over $600.00 to my parents would be considered preferential?

Unless you're on one of the coasts or in Florida, $600/mo should rent a decent apt.
Hubby's was $500/mo. Very spacious. 700 sq ft. With laundry (washer and dryer in the apt), water, and trash included. And each building had softened water. Which is a very big deal here. Electric bill ran about $50-$60/mo.
Dives here go for $300-$350/mo. Maybe you should take a look around and see what you can get for how much before you decide.
Personally, I'd worry about the preferential payment thing too much and would rent from an outside Landlord.
You'll need at least 2-3 months of payments receipts to turn in to the attny. Attnys keep copies of that stuff on file in case your file gets pulled for audit.Filed Ch 7 - 09/06

Heres the problem scammer... Renters rent for reasons that include, not having good enough credit to buy a house, or not having the money, etc. Rather than paying a service to screen out those with good credit, all you have to do is an old school method of screening commonly called 'references'. See, you call the applicants last few landlords, that will give you a much much better idea of how they will be as tenants

Please don't take me as being to good to rent to anyone who has bk'd. Kinda like the pot calling the kettle black, since I bk'd myself. I just choose to go after a higher end renter and been successful with that strategy. If I had an appt bldg, with a handyman on full time. I could stomach lower deposits and no credit checks. Calling old landlords has become quite difficult with the privacy act, I am lucky if they even share that they have been late on the rent.
