My wife signed a reaffirmation agreement for her suv and on it it listed $8600 that we owe and $150 for attorney fee. Now that we are discharged the loan company is saying we owe $298 for fees. Can they just change the fee even though $150 is stated in a written contract signed by both parties that was filed with the court ? Has this ever happened to anyone else ? She received no invoice for these additional fees and she called the loan company and they are saying we have to pay $298 now. How should I handle this ?

With our attny, handling a reaffirmation would be an additional charge. Was the $150 written into the agreement the fee your attny was charging you??
Could it possibly be that the Lender's attny is charging the additional amount??
That wouldn't really make sense tho. Because you would have paid your attny whatever fee he/she charged seperate.
It really does not make sense. Sounds kinda like a bait and switch to me.
Have you been able to get the Lender to explain why your contract says one thing and now they are charging more??Filed Ch 7 - 09/06

I am not an attorney. My comments are based on personal experience and research. Always consult an attorney in your area to address concerns related to your particular situation.

It is the loan company's attorney charging the additional fee not ours. My wife called the loan company today and they just said $298 is for attorney's fee but the reaffirmation she signed only says $150 will be charge for attorney's fee. I want to call my attorney but feel he will charge extra since our case is now closed and discharged. I do not see how she can sign a contract to reaffirm and then they try to change the fee to double. It is only $148 but it is the point of the matter to me. She has a contract to pay what she owes and $150 extra.
