    former Trustee as Atty?

    Is there a significant advantage to retaining a BK atty who is a former BK trustee? My initial impression is yes, but I'm also curious if it's enough of an advantage to warrant paying a (slightly) higher fee?

    Also this particular atty makes a point (on his literature) of noting that he's "Board Certified" in BK Law ... how is that different than licensed to practice BK law? ... and again, does that offer a significant advantage?

    An attorney that has also served as a Trustee will "know" what a Trustee is looking for, expecting, and will demand in a bankruptcy case.......
    An advantage....... yes.....................
    Costing more, probably worth the extra money.......
    Also has a better relationship with the trustee's circle of friends than a regular attorney.....

        Thanks. Yeah I kind of thought it was a "well duh!" question but we've met with a few different lawyers and haven't found one we like yet. Just walked out of a consultation with one in particular that was a real prick!
        We have an appt with one who is a former trustee on Tuesday.

          How about hiring an attorney that's currently a trustee?

          Gotta love lawyers.....especially ones that get to graze on both sides of the fence.

            I purposely sought out practices where there was an attorney that was a current trustee. My actual attorney is not the trustee, but we called in his partner (the trustee) to ask him some questions. I really lucked out since I'm in an outlying area and this trustee is from the same remote district so he knows how things differ there. And I was not charged higher (in fact, much lower than other places). Under $1500 and that includes filing fees.

              But realize that Chapter 7 trustees only get about $100 per case. (It's not like Chapter 13 trustees getting a cut for years to come.) They are trying to raise the compensation for Ch 7 trustees since that is actually quite a bit of work for that sum.

                The attorney I am going to be using is currently a trustee. I thought it would be a good benefit... Like the other poster said, he would know about what they are looking for
                3/27/07: Chapter 7 Filed - Pre-filing true FICO (hers/his) 450/477
                5/10/07: 341 Meeting DONE! Trustee's Report of No Distribution Filed
                7/04/07: FICOs going up! Credit report cleanup (hers/his) 540/536
                7/10/07: DISCHARGED! 8/27/07: CLOSED!
