    Many purchases (including $1000 down pay charged) on one CC...

    My attorney told me to wait for 90 days to file for B/K because I charged a lot on one of my many cards and on that same card put a $1000 down payment on a car (not a cash advance, a charge made at the car dealership). What is the reasoning behind this? I had no intention of filing B/K at the time we bought the car (almost 2 months ago)... I just had realized how VERY in over our heads we are. I am filing alone, w/o my hubby. He doesn't want to be touched by the B/K. So, if I wait 90 days to file, is it 90 days from the big charge I made or 90 days from when I talked to him? Also, I have a couple of CCs that were opened up this year (the one with the big charge included). The rest were last year or the year before. Do you anticipate me having any problems? Most of the debts are CC debts and one is a medical bill... am not trying to get rid of any secured debts. Any suggestions or advice? Thanks!

      I would wait more then 90 days depending upon what "a lot" is and what you bought with it. If you don't have much money as you probably don't, just make 4 or 5 months of good faith payments to the one card, then stop paying and file. Stop paying on all other cards now.
      It's technically the time you spoke with the attorney, but the courts and creditors will look at the time you retained the attorney since you have to list this payment on you petition.

        Thanks for your replies. The only MAJOR purchase I made was the $1000 down payment, and probably 500-1000 in general purchases (groceries, gas, etc.- nothing huge like a big screen TV or camcorder or anything).

          90 days should be fine then. This is probably too small an amount for a creditor to dispute for items that aren't considered luxuries or cash advances.
