    Do you need a lawyer??

    I was wondering if I could file on my own (to save money) and not need a lawyer...Can anyone tell me the steps I need to take and the forms I need to fill out....Please...! Thank you. (I am in California)

    No offence but because you were a member of this forum since January which is when you probably started thinking about bankruptcy you probably should have researched the subject night and day so you could answer the question yourself. Not trying to be mean, but if you know so little in a 6 month period I would hire a good lawyer no matter what the cost. If you search this forum not only will you find the answer to your question, but you will find out that under new law most of the cases where trouble arises are the cases filed pro se. You must know what your doing or it will cost you more then the attorney. Good luck!

      I agree with all of that. You can file pro-se, many of us have done it successfully. But noone is going to do it for you, you have to do it for yourself.

        This forum is great; however, sometimes people need a bit of a step-by-step or organized view of the procedure.
        • Go find the official California BK web site for your area.
        • Read the tactical bankruptcy manual found in a sticky on this web site.
        • Personally, I like the book from Nolo.com on filing. Well organized and line-by-line instructions for the forms. However, it does not replace legal advice.



        On the California BK site, look to see if the court gives seminars on pro se filing.

        Go have a few free consultations with lawyers (don't tell them you are considering pro se filing.)

        If you have assets you are trying to keep--particularily a house, I would never chance filing pro se. That's too much of a gamble for me.
