    They closed my Orchard Bank Card.....

    Yup they found out about it

    They also closed it as IIB They weren't IIB though!!!!! The date I filed with them I didn't have any balance on them. I did use it a couple days afterwards and I do owe them that amount. How can they do that? I called the guy and told him that I in fact do owe them that and I want to pay it and they said nope sorry.

    Tell them to shove it up their ass and save some money for a secured card savings account. You can have some savings and reestablish credit just as effectively. Good luck.

      I was thinking that was the way to go. Maybe I'll get a couple secured cards and re-establish with that. I do need to find a way to get a car as well....so as long as I find someone to lend me for a car I'm good.

        I've never had to open a secured card, ever. Once you are debt free and it shows on your reports, there are plenty of bk friendly lenders to try that aren't ripoffs like aspire and first premier. You will see. If you apply to maybe 10 of them right away you'll get a couple of them approved. Its a start.

          This is true even though some banks may offer higher rates. It's better to save that money for your rent or bills.
          My credit scores:
          Before Filing: Tr 496, Ex 496, Eq 507

          Today: Tr 618 (+122), Ex 601 (+105), Eq 623 (+116)

            isn't it risky to use credit cards after filing bankruptcy (when it is still an open case?)

              Well seeing as I'm using $78 on it....and what was purchased was gas and food......I'm not really fearful of them coming back to say pay it. The card was used and paid every month in full. Now if I went and bought a big screen on it, then yeah I think my butt would be on the line big time.

                I agree with Newday. Your not supposed to be using any kind of credit while in any type of bankruptcy without the courts permission.

                  Ditto...our lawyer was adamant about not applying for or using any credit cards immediately prior to or during BK. Look at it from the creditor's perspective...you are filing on them and using their card knowing you are? I had a friend who had a Dillard's card that she used prior to BK to buy her son's clothes...sure she could have gone somewhere else and probably should have...Dillard's objected to the charges but only with her attorney...luckily she was able to dodge the bullet; Dillards did not pursue the case and the courts never found out but she was lucky..and she knew it.

                        Our lawyer said..... BIG NO NO!!!! They don't care if it is $5 or $5000....credit is credit.

                        There is also a time period you have to wait.
                        You have to stop using your credit cards BEFORE you file.

                        Here's another point ...because you are using the card, that means you are paying on the card.....right? Well if your other creditors catch wind that you are paying a debt and not theirs...bad news OUCH!!! They can object to your discharge and then your filing BK was for nothing!! You didn't even have your 341 yet!! WHY take the risk??? Is it really worth it??

                          Not worth it.....I didn't think anything of it really. I needed food and gas.....seriously had like 26 cents to my name haven't touched it since. I guess I'll wait to the 341. Should I even mention I used it? Orchard told me don't worry about it they're doing IIB and not disputing.
